Areas of Practice

José María Ortega heads the Civil/Commercial Litigation, Bankruptcy, and International Arbitration practices.

In commercial litigation, he represents national and international entities in a wide range of commercial conflicts, such as those related to the fulfillment of financial leasing contracts, pure leasing, factoring, execution of trusts and mortgage guarantees, as well as disputes related to construction contracts, energy, transportation, conflicts between shareholders, challenge to corporate agreements, among others.

In matters of bankruptcy, José María has advised both debtors and creditors in the different phases of the insolvency procedure, such as the visitation, conciliation and bankruptcy stages. He also has vast experience in the negotiation of agreements with creditors and debtors.

He has served as an expert in Mexican law for various commercial and insolvency proceedings before the Courts of the United States of America.

José María also has extensive experience in arbitration, both domestic and international, participating in important arbitrations on compliance with contracts, conflicts between shareholders, construction, energy and banking.

Relevant Issues

  • Represents Societe Generale in complex commercial contract enforcement proceedings.
  • Represents Unifin Financiera in legal disputes related to pure leasing and financial factoring contracts, with implications for the execution of mortgages, pledges and trusts.
  • He has represented Caterpillar in a wide variety of financial leasing contract enforcement proceedings.
  • He has acted as counsel for creditors and debtors in bankruptcy proceedings for companies such as Ahmsa, ICA, Tribasa, Mexicana de Aviación, Oceanografía, Star Haus, among others.
  • He represented Halliburton in a complex international arbitration proceeding under the ICC rules.
